2. About Clever Punts & Acceptance of Terms

Clever Punts is a digital information and data platform providing horse racing form, odds comparisons, football statistics, AI-generated selections, and related content for informational and entertainment purposes. Clever Punts is not a bookmaker and does not hold a Gambling Commission operating licence. We do not accept bets, manage funds, or provide regulated financial services of any kind.

By accessing the Site, creating an Account, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety, together with our Cookie Policy and Privacy Policy, which are incorporated herein by reference.

If you do not agree to these Terms, you must immediately stop using the Site and, where applicable, close your Account.

3. Age Restriction & Eligibility

You must be 18 years of age or older to use this Service. By registering an Account or using the Site, you confirm that you are at least 18 years old. This requirement exists because the Site contains content directly related to gambling, including odds, racing tips, and betting-adjacent information.

We reserve the right to ask you to verify your age at any time. Where we have reasonable grounds to believe a user is under 18, we will suspend that Account immediately without notice and may permanently terminate it.

In addition to the age requirement, you confirm that:

• You are a natural person (not an automated system, bot, or corporate entity registering under false pretences);
• Your use of the Service is for personal, non-commercial purposes unless expressly agreed otherwise in writing;
• You are not accessing the Service from a jurisdiction in which the receipt of gambling-related information is prohibited by local law. It is your responsibility to ensure compliance with the laws of your jurisdiction.

4. Account Registration & Security

4.1 Registration

To access certain features of the Service you must register for an Account. When registering, you agree to provide accurate, complete, and current information including a valid email address. You must keep your account information up to date. Providing false registration details is a breach of these Terms.

Passwords must meet the minimum security requirements set out on the registration page (minimum 12 characters). We strongly recommend using a unique password not used on other services.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must not share your Account with any other person. Each Account is for a single named individual only. Sharing access — including sharing login details to circumvent a Paid Subscription limit — constitutes a material breach of these Terms.

If you suspect unauthorised access to your Account, you must notify us immediately at privacy@cleverpunts.com and change your password without delay.

4.3 Email Verification

Account registration requires email verification. We will send a verification link to the email address you provide. Accounts that remain unverified may have restricted access or be removed after a reasonable period.

4.4 One Account Per Person

You may hold only one Account. Creating multiple Accounts — including to circumvent a suspension, access a Free Tier multiple times, or otherwise abuse the Service — is prohibited and will result in all associated Accounts being terminated.

5. Membership & Subscriptions

5.1 Free Tier

The Site currently offers a Free Tier membership available to all registered users. The Free Tier provides access to a defined subset of content and features as described on the Site. We reserve the right to modify the features available on the Free Tier at any time, with or without notice, including moving features previously available on the Free Tier to a Paid Subscription.

5.2 Paid Subscriptions (Coming Soon)

Clever Punts intends to introduce one or more Paid Subscription tiers in the future. When Paid Subscriptions are launched, the specific features, pricing, and billing terms will be clearly presented on the Site prior to purchase. Purchasing a Paid Subscription will constitute acceptance of the specific subscription terms presented at that time, in addition to these general Terms and Conditions.

We will provide reasonable notice to existing registered users before introducing Paid Subscriptions. Where features currently available for free are moved behind a paywall, we will endeavour to give Free Tier users a minimum of 30 days’ prior notice.

5.3 Changes to the Service

We reserve the right to add, modify, or remove features, content, and functionality from the Service at any time. Where such changes materially reduce the value of a Paid Subscription (once introduced), we will provide at least 30 days’ prior notice and offer affected subscribers a proportionate remedy.

6. Payments, Billing & Refund Policy

6.1 Current Billing

As the Service is currently free, no payment is required to access the Site. This section will become fully operative when Paid Subscriptions are introduced.

6.2 Payment Processing

All future payments will be processed securely through Stripe, our third-party payment processor. By purchasing a subscription, you will be required to provide valid payment details. We do not store your payment card details on our systems; all card data is handled exclusively by Stripe in accordance with PCI DSS standards.

6.3 Automatic Renewal

Paid Subscriptions will renew automatically at the end of each billing period (monthly or annual, as applicable) unless cancelled before the renewal date. You will be notified of upcoming renewals as required by applicable law. By subscribing, you authorise us to charge your payment method on a recurring basis for the subscription fee in effect at the time of each renewal.

6.4 Cancellation

You may cancel a Paid Subscription at any time through your account settings or by contacting us at privacy@cleverpunts.com. Cancellation takes effect at the end of your current billing period. You will retain access to your subscription features until the period you have already paid for expires.

6.5 Refund Policy

This means that if you subscribe and immediately access the premium content, no refund will be issued for the remainder of that billing period should you cancel. This exemption will be clearly presented and require your active confirmation at the point of purchase.

Exceptions to this policy may be made at our sole discretion in cases of technical failure that prevents access to the Service for a significant portion of the billing period. Such requests must be submitted within 14 days of the issue occurring.

6.6 Failed Payments

If a payment fails, we will attempt to contact you using the email address on your Account. Access to paid features may be suspended until payment is successfully collected. Repeated payment failures may result in Account termination.

6.7 Price Changes

We reserve the right to change subscription pricing. You will be given a minimum of 30 days’ notice of any price increase before it takes effect on your Account. Continued use of the Service after a notified price change constitutes acceptance of the new pricing.

7. Nature of Content & No-Advice Disclaimer

The Site provides data, statistics, odds comparisons, race form guides, editorial content, and algorithmically generated selections. This content is intended to inform and entertain. It does not take into account your personal financial circumstances, risk tolerance, or any other individual factors relevant to gambling decisions.

Clever Punts expressly disclaims all responsibility for any losses — financial or otherwise — incurred as a result of acting on any content, prediction, selection, tip, or other material found on the Site. You bet entirely at your own risk.

Past performance of any selection, algorithm, or tipster does not guarantee future results. Gambling involves risk and you should never bet more than you can afford to lose.

8. AI-Generated Predictions

The Site incorporates AI-generated horse racing and sports predictions produced by automated algorithmic systems. These predictions are generated by processing historical data, form guides, statistical models, and other inputs. You should be aware of the following:

• No guarantee of accuracy: AI predictions are statistical in nature. They will be wrong. No prediction, however confident its score or rating, should be treated as a certainty.
• Not advice: AI-generated content is algorithmic output, not the opinion of a human expert and certainly not financial or betting advice.
• No liability for losses: Clever Punts accepts no liability whatsoever for any financial loss suffered as a result of acting on AI-generated predictions, selections, ratings, or any related content.
• Experimental nature: AI systems are continuously evolving. The models, weighting, and outputs may change without notice as we improve our systems.
• Entertainment purpose: AI predictions are provided as an entertainment feature and a tool for your own research, not as a reliable standalone betting system.

9. Affiliate Links & Commercial Relationships

The Site contains affiliate links to third-party services including but not limited to bookmakers, tipster services, racing media platforms, and related products. When you click an affiliate link and subsequently sign up for, purchase, or deposit with a third party, Clever Punts may receive a commission or other remuneration from that third party.

The presence of an affiliate link does not constitute an endorsement, recommendation, or guarantee of any third-party service. Affiliate relationships do not influence the editorial content or predictions published on the Site beyond the inclusion of the link itself.

All commercial relationships are disclosed in accordance with UK ASA/CAP guidelines. Affiliate content will be clearly identified where required.

Clever Punts accepts no responsibility for the content, practices, terms, or reliability of any third-party service reached via an affiliate link. Any dispute or issue arising from your use of a third-party service is solely between you and that third party.

10. Acceptable Use

By using the Service, you agree not to:

• Use automated tools, bots, scrapers, crawlers, or scripts to access, copy, index, or harvest any content, data, or odds from the Site without our express written permission;
• Reproduce, redistribute, publish, or commercially exploit any Content from the Site without prior written consent;
• Share your Account credentials with any other person, or allow any third party to use your Account;
• Create or use multiple Accounts to gain unfair access to the Service or to circumvent restrictions;
• Attempt to probe, scan, test, or exploit any vulnerability in the Site, its systems, or its underlying infrastructure;
• Reverse-engineer, decompile, or disassemble any part of the Site or its software;
• Transmit unsolicited communications, spam, or promotional material through any feature of the Service;
• Upload or transmit any malicious code, malware, ransomware, or other harmful software;
• Use the Service in any manner that could damage, overburden, impair, or disrupt the Site or servers or networks connected to the Site;
• Misrepresent your identity or impersonate any person or entity;
• Use the Service for any unlawful purpose or in violation of any local, national, or international law or regulation;
• Access the Service from any jurisdiction in which accessing gambling-related content is prohibited by law.

We reserve the right to monitor use of the Service and to investigate suspected breaches of this acceptable use policy. Breach of this clause may result in immediate Account suspension or termination, and we reserve the right to take legal action where appropriate.

11. Intellectual Property

11.1 Ownership

All Content on the Site, including but not limited to text, graphics, logos, interface design, source code, data presentations, AI model outputs, editorial copy, and the Clever Punts brand, is the intellectual property of Clever Punts or its licensors and is protected by copyright, database rights, and other applicable intellectual property laws.

11.2 Licence to You

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its Content for your own private, non-commercial use in accordance with these Terms. This licence does not include the right to download, copy, reproduce, republish, distribute, transmit, broadcast, or create derivative works from any Content, except as expressly permitted herein or with our prior written consent.

11.3 Data & Odds

Odds data, race card data, and sports statistics displayed on the Site are sourced from third-party data providers under licence. These data rights belong to the respective providers. Scraping, harvesting, or reproducing this data in bulk is strictly prohibited and may constitute a breach of the Computer Misuse Act 1990 and/or the Database Directive.

11.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use that feedback in any way we choose, without obligation to you.

12. Third-Party Services & External Links

The Site integrates or links to third-party services including Stripe (payment processing), Cloudflare (security and performance), external bookmakers, tipster platforms, and data providers. Your use of third-party services is governed solely by the terms and privacy policies of those third parties.

Clever Punts is not responsible for the availability, accuracy, content, or practices of any third-party service or website linked from the Site. The inclusion of any link does not imply endorsement by Clever Punts.

If you use Stripe to make a payment, you are additionally subject to Stripe’s Terms of Service.

13. Data Accuracy & Service Availability

13.1 Data Accuracy

Whilst we take reasonable steps to ensure the accuracy of odds, race data, statistics, and other information displayed on the Site, we cannot guarantee that such information is accurate, complete, or up to date at any given moment. Odds data in particular is subject to continuous change and may lag behind live market prices. Always verify odds directly with a licensed bookmaker before placing a bet.

Clever Punts accepts no responsibility for losses arising from inaccurate, incomplete, delayed, or missing data.

13.2 Service Availability

We aim to provide a reliable and continuously available service but do not guarantee uninterrupted access. The Site may be unavailable from time to time due to maintenance, technical issues, third-party provider outages (including upstream data APIs), or events outside our control.

We accept no liability for any loss or inconvenience caused by downtime or service interruptions, whether planned or unplanned.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

• Clever Punts provides the Service on an “as is” and “as available” basis, without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement;
• Clever Punts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any financial losses arising from your use of, or inability to use, the Service;
• Clever Punts shall not be liable for any gambling losses or betting-related financial losses incurred by you, regardless of whether those losses followed from your use of content, predictions, or data from the Site;
• Where liability cannot be fully excluded by law, our total aggregate liability to you in connection with the Service shall not exceed the total amount paid by you to Clever Punts in the 12-month period immediately preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded under the laws of England and Wales.

15. Account Suspension & Termination

15.1 Termination by You

You may close your Account at any time by contacting us at privacy@cleverpunts.com or by using the account deletion option in your account settings. Closing your Account does not entitle you to a refund of any subscription fees paid in the current billing period.

15.2 Suspension or Termination by Us

We reserve the right to suspend or permanently terminate your Account, with or without prior notice, in the event of:

• A material breach of these Terms, including any breach of the Acceptable Use provisions;
• Fraudulent activity, including chargebacks, payment fraud, or misuse of promotional offers;
• Evidence that the Account is held by a person under 18;
• Creation of multiple Accounts in breach of these Terms;
• Any conduct we determine, acting reasonably, to be harmful to Clever Punts, its users, or third parties;
• A legal or regulatory requirement to do so.

Where a paid subscription is terminated for cause (i.e. due to a breach by you), no refund will be issued for the remaining subscription period.

15.3 Effect of Termination

Upon Account closure or termination, your right to use the Service ceases immediately. Clauses that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) will continue to apply.

Your personal data will be handled following termination in accordance with our Privacy Policy.

16. Responsible Gambling

Although Clever Punts is not a gambling operator, we recognise that our content is used in a gambling context and take our responsibility to promote safe gambling seriously.

Gambling should be an enjoyable activity. If you feel that gambling is negatively affecting you or someone you know, please seek help. The following free, confidential services are available in the UK:

18. Governing Law & Disputes

These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

If you are a consumer resident in Scotland or Northern Ireland, you may also have the right to bring proceedings in the courts of your home jurisdiction.

18.1 Complaints

If you have a complaint about the Service, please contact us in the first instance at privacy@cleverpunts.com. We will endeavour to respond to all complaints within 5 working days and to resolve them fairly and promptly.

If you are a UK consumer and we are unable to resolve your complaint, you may be entitled to refer your dispute to an Alternative Dispute Resolution (ADR) scheme or to the courts. We will advise you of available options if a complaint cannot be resolved internally.
